My PERM Statistics

Statistics is a tricky science. The end result always seems to depend on who is counting and how. I noticed that some of my colleagues have been bragging about their labor certification approvals under the PERM by listing selections of their approved cases, often sorted by positions for which these labor certifications have been obtained, without mentioning their total number of cases which would provide a meaningful data sample for objective analysis. Though it appears to me that if an attorney wants to brag about PERM approvals, there is simply no other way to objectively measure his performance than by including all, not some, cases prepared and filed since March 28, 2005 (the date the PERM was implemented) as one’s data sample and list their respective outcomes. And then see if there is still something to brag about…or not. So in the spirit of full disclosure:

Total number of PERM cases that I prepared and filed with the U.S. Department of Labor to date:  93

Total number of adjudicated cases to date: 85

Total number of filed and pending cases awaiting decision: 6

Total number of cases withdrawn: 2

Total number of cases approved (application certified):  79

Total number of cases denied: 6

Total number of these denials reversed on appeal to the U.S. Department of Labor: 3

Total number of these denials cured by refiling the application and obtaining approvals upon refiling: 2

Therefore, as of May 2, 2012, my PERM record so far is 84 wins and 1 loss. Not bad, huh?
